By accessing or using Loop Jersey's services, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions, you may not access or use our services.
2. Service Description and Contractual Relationships
Loop provides a platform connecting customers with local businesses and independent drivers for food and product delivery. We do not prepare food or products ourselves but facilitate the ordering and delivery process.
Important: Loop does not contract directly with customers for the sale of goods or delivery services. Instead, Loop contracts separately with businesses and drivers who use our platform. When you place an order, your contract for the purchase of goods (including delivery) is directly with the business. The business is responsible for fulfilling your order, including arranging delivery through drivers who are assigned to deliver on behalf of the business. Loop acts as a facilitator and payment processor, collecting payments on behalf of businesses and drivers.
By using our platform, you acknowledge and accept these contractual arrangements. Loop's role is limited to providing the technology platform, processing payments, and facilitating communication between all parties.
3. User Accounts
To use certain features of our service, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
4. Ordering and Delivery
When you place an order through Loop, you are making an offer to purchase products (including delivery service) directly from the selected business. Loop facilitates this transaction but is not a party to the contract between you and the business. The business is responsible for fulfilling your entire order, including arranging delivery through drivers who deliver on behalf of the business.
Delivery times are estimates provided by businesses and may vary based on factors outside Loop's control. Any issues with product quality, order accuracy, or delivery service should be addressed directly with the business, as they are responsible for the complete fulfillment of your order. Loop may assist in facilitating communication and resolution between you and the business.
5. Payments
All payments are processed securely through Loop's platform. Loop acts as a payment processor, collecting payments on behalf of businesses and drivers. By providing payment information, you represent that you are authorized to use the payment method.
Prices are set by individual businesses and may change at any time. Loop receives a revenue share from businesses for providing the platform and payment processing services. No additional service fees are charged to customers.
6. Cancellations and Refunds
Cancellation policies are set by individual businesses and may vary. As Loop is not a party to the contract between you and the business, refund decisions are primarily the responsibility of the business. This includes refunds for delivery-related issues, as the business is responsible for the complete fulfillment of your order including delivery.
However, Loop may facilitate refund processing and may issue refunds at its discretion in cases of platform-related issues or to maintain service quality and assist in resolution between you and the business.
7. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
8. Limitation of Liability
Given Loop's role as a platform facilitator and payment processor, Loop is not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our platform or any products ordered through it.
Loop is not responsible for the quality, safety, or legality of products offered by businesses, the accuracy of business listings or product descriptions, or the ability of businesses to fulfill orders (including delivery services). Your primary recourse for issues with products or delivery is with the business, as they are responsible for complete order fulfillment.
Loop's liability is limited to facilitating communication and payment processing. Any disputes regarding products or delivery services should be resolved directly with the relevant business.
9. Changes to Terms
We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the new terms.
